The technical glitch caused a delay between gantry signs displaying a speed limit change and the cameras registering it. This resulted in drivers being incorrectly clocked as speeding, even when they were traveling at the displayed speed. It was only discovered when drivers presented dashcam footage in court, proving their innocence.
At one point, the police had to turn off cameras due to reliability concerns. Over four years, an estimated 154 speed cameras were affected, leading to around two mistakes daily, or roughly 0.1% of camera activations.
The independent review is welcomed, but it also raises questions about other potential failings. Philip Somarakis, a criminal and regulatory lawyer at Irwin Mitchell, told the Daily Mail: "We're glad for the review, but the issues with variable speed limit enforcement may go back even further than we thought. The review's scope includes investigating how technical and operational issues, including this anomaly, are identified and escalated within National Highways. This is not an isolated incident, and it makes one wonder if other failings will be uncovered."
The new review, led by DfT board member Tracey Westell, will investigate how this malfunction occurred and whether it could have been detected sooner. By reviewing cases back to 2019, many more drivers could have their convictions quashed. Already, 2,650 innocent drivers have been identified, and police have canceled speed awareness courses for 36,000 drivers as a precaution.
National Highways has apologized for this blunder and states that new checks are in place to prevent future incorrect prosecutions. A spokesman assures that the cameras can still enforce the 70mph national speed limit on affected motorways. This scandal further questions the safety of smart motorways, which use variable speed camera technology to manage traffic flow and congestion.
